Terms of service#

These terms govern the use of domainsearch24.eu ("the service"), operated by botBrains GmbH, Berlin ("we"). By using the service you accept them.

The service#

domainsearch answers whether domain names appear to be registered, via a web interface and a JSON API. It aggregates public sources (DNS, RDAP registries, ICANN zone data, Common Crawl). The service is provided free of charge.

No guarantee of correctness#

Availability results are best-effort signals, not legal or commercial advice and not a reservation:

• A free result is a moment-in-time answer from the responsible registry. The name may be registered by anyone at any moment, may be reserved, premium-priced, or restricted by registry policy.
• A registered result may be stale for sources with a staleness window (documented in the API reference).
• We accept no liability for decisions made on the basis of an availability result, to the extent permitted by law.

Fair use#

Anonymous use is rate limited. You must not attempt to circumvent rate limits, disrupt the service, or use it to build bulk registration-sniping pipelines that burden the underlying registries. We may throttle or block abusive traffic without notice.

API and data terms#

These terms apply to any access to the API, the technical interfaces, and the data they return ("service data").

Limited licence#

We grant you a limited, non-exclusive, non-transferable, non-sublicensable and revocable right to use the API and service data for your own purposes. No ownership, intellectual property or database rights are transferred. Free access does not make the service, service data or interfaces public-domain or unrestricted.

No resale or redistribution#

You may not, directly or indirectly (including through affiliates, contractors, proxies or other third parties):

• sell, resell, rent, sublicense or otherwise commercially provide access to the service, the API or an API key;
• expose the service or service data through another API, proxy, data feed, downloadable dataset or substantially equivalent interface;
• redistribute, syndicate or commercially license service data to third parties; or
• offer a product where access to the service or service data is itself a material part of what is sold.

Using individual results internally, or displaying limited results as an ancillary feature of a broader product, is not resale.

No competing services#

The service, service data and interfaces may not be used to create, operate, improve, train, supply or materially support a competing service: a product whose primary or material purpose includes domain availability lookup or bulk checking, domain discovery or name search, domain-name generation or recommendation based materially on service data, domain marketplace aggregation, availability/registrar/pricing comparison, commercial domain datasets derived materially from the service, or an API with substantially similar functionality. This applies whether the competing service is free or paid. A broader product where domain search is an incidental, subordinate feature is not a competing service, unless service data is used to reproduce a substantial part of our functionality.

No substitute dataset#

You may not systematically collect, cache, combine, reconstruct or retain service data to build a substitute for our database, an independent or historical availability dataset, or anything intended to reduce the need to access the service. Normal short-term caching needed for technical operation is fine.

No circumvention#

Access only through the interfaces we provide for the purpose. You may not circumvent API keys, quotas or rate limits, rotate accounts or credentials to evade limits, scrape where automated access is prohibited, conceal who actually operates or benefits from the access, or share API credentials between unrelated legal entities.

Database rights#

To the extent our databases are protected under applicable copyright or database law, all rights are reserved. Nothing here permits reproduction, extraction or systematic reuse beyond the licence above; the contractual restrictions apply regardless of whether an individual data element is itself protected.

Enforcement#

A violation of these API and data terms is a material breach. We may immediately suspend or terminate access, revoke API keys, block accounts, applications, IPs or other identifiers, and require deletion of unlawfully retained service data. We expressly reserve all legal remedies, including injunctive relief (also preliminary relief where available), damages, and claims from copyright, database rights, trade secrets or unfair competition law independently of these terms; this includes legal action against anyone operating or materially supporting a competing service in violation of these terms. You remain responsible for violations committed through your accounts, credentials, employees, agents or contractors to the extent attributable to you under applicable law. Termination does not affect claims arising before it.

Availability#

We aim for high availability but provide the service "as is", without warranty of any kind. We may change or discontinue the service or the API at any time; breaking API changes are versioned under a new path where practical.

Liability#

For a free service, our liability is limited to intent and gross negligence, and to damages arising from injury to life, body or health. Mandatory statutory liability remains unaffected.

Governing law and jurisdiction#

These terms and all use of the service are governed exclusively by the laws of the Federal Republic of Germany, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods (CISG), to the extent this choice is legally permissible; mandatory statutory provisions remain unaffected. If you are a merchant, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction is Berlin, Germany; we remain entitled to bring proceedings at any other legally competent court.

Severability#

If a provision of these terms is or becomes invalid or unenforceable, the rest remains unaffected; statutory law applies in its place. All rights not expressly granted are reserved, and not enforcing a provision is not a waiver of it.
